Please read these Terms of Use ("Terms") carefully before using The Gym Genius mobile application ("the App") operated by The Gym Genius ("we", "us", or "our").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.

By downloading, installing, or using our App, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use our App.

We recommend that you print a copy of these Terms for future reference.

We may revise these Terms at any time by updating this page. We will try to give you reasonable notice of any major changes. By continuing to use the App after such revisions, you agree to be bound by the revised Terms.

It is your responsibility to check these Terms periodically for changes. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.

Your use of our App is also subject to our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and share information when you use our App.

Please review our Privacy Policy, which also governs your use of the App.

To access certain features of the App, you may be required to register for an account. You must provide accurate, current, and complete information during the registration process and keep your account information up-to-date.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to terminate or suspend your account at any time without notice if we determine, in our sole discretion, that you have violated these Terms.

Our App may allow you to submit, store, or share certain content, including workout data, personal information, and preferences ("User Content").

By submitting User Content to the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and improving our services.

You represent and warrant that:

• You own or have the necessary rights to the User Content you submit
• Your User Content does not violate any third party's intellectual property or privacy rights

The App offers subscription-based services through Apple's In-App Purchase system. By purchasing a subscription, you agree to the following:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase

All purchases are final and non-refundable, except as required by applicable law. Refund requests should be submitted through Apple.

The information provided by the App is for general informational and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Before beginning any exercise program or nutrition plan, you should:

• Consult with your physician or other healthcare provider
• Ensure you are in good physical condition
• Stop exercising immediately if you experience any discomfort or pain

You use the App and follow any workout recommendations at your own risk. We are not responsible for any injuries or health problems that may result from following the recommendations provided by the App.

The App and its original content, features, and functionality are and will remain the exclusive property of The Gym Genius and its licensors. The App is protected by copyright, trademark, and other laws.

You may not:

• Copy, modify, or distribute any part of the App without our prior written consent
• Use any automated means to access the App
• Attempt to reverse engineer any portion of the App
• Remove any copyright or other proprietary notices from the App

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App and delete it from your device.

To the maximum extent permitted by law, in no event shall The Gym Genius, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or use, or any other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any unauthorized access, use, or alteration of your transmissions or content

These Terms shall be governed and construed in accordance with the laws of the jurisdiction where The Gym Genius is established, without regard to its conflict of law provisions.
